Amy Coney Bennett — an Activist Enigma

Through the fast pitched decision the Senate and President Trump made to elect Amy Coney Barrett as a Supreme Court Judge bipartisan reflections were made that were memorable and encouraged viewers to support our nation as a whole. Bipartisan efforts from the Democrat party to encourage Barrett were bold. Barrett embraces justice for all and told the camera she wants to condemn racism and will fight in her own capacity to end all racicsm as a major portion of her seat.

At 4:30 pm Republican Senator Mike Crapo of Idaho spoke that Barrett has no plan to be against health coverage which the Democrats have voiced opinion of, “[You are] being attacked on the basis of concerns about your willingness and precision, there is a whole new era of judicial activism — pushing an agenda that you don’t admit to having”

Barrett stated that no one is above the law in the United States in agreement with Republican Senator Mike Crapo. Barrett also told the audience she always wanted to teach law. When in law school she planned to become a law professor. Her favorite subject to teach today is Constitutional or federal law. She also taught evidence law.

Barrett spoke next with Senator Kamala Harris Democrat Senator of California. Harris spoke about detailed manners regarding health care and science — and asked Barrett what her opinion was. Harris ended with the following comments

“This hearing has done nothing to alleviate the concerns — when the American people deserve to be heard. There are countless issues at state and people are very scared about what it means to future voting rates — for civil rights — for climate change — and the right to a safe and legal abortion — pre existing conditions — I am deeply concerned about the nation’s timeless principle — and I share those concerns.”

Republican Senator John Kennedy of Louisiana asked Barrett if she supported corporations over working people. Barrett responded “I am not against any of those things — those are policies that Congress has pursued in many statutes.”

Republican Senator Chuck Grassley of Iowa spoke to Amy Coney Barrott next. Senator Grassley stated ‘The nominee was well qualified on her judicial philosophy.” Grassley asked Amy if she was familiar with the false claims act which he served with. In 1986 legislation was drafted to make false claims act an effective tool — this law enlisted the help of private citizens — in 2000 the Supreme Court claimed this law Constitutional. $68 billion of tax payers dollars were reclaimed.

Senator Grassley asked Amy if she had ever written or spoken of the Constitutionality of the false claims act. “Do you have any pre-conceived claims about the false claims act?”

Amy Coney Barrett responded “No I do not. The act I would approach with an open mind like any other.”

Senator Grassley also stated the cameras in the court room and legislation on this — while it is not a popular subject — leads to the question should cameras be allowed in the Supreme Court?

Grassley ended with the statement ‘In my view the US Constitution is the fundamental law of the American People — it would not be controlled by laws of other countries because it impacts federal laws that we make.”

Amy Coney Barrett was addressed by Senator Sheldon Whitehouse (D-RI). Whitehouse first stated ‘canons of judicial conduct do not apply to the supreme court — there is no 7th circuit law.’ Senator Sheldon Whitehouse explained to Amy Coney Barrett this is something she should flag anonymously that the lowest court has no standards and this should be altered. Senator Sheldon Whitehouse was passionate about speaking with Amy Coney Barrett which seemed in favor of the bipartisan movement.

Senator Sheldon Whitehouse reminded Barrett that anybody can request her financial report. Whitehouse also stated litigation winding its way through the courts and to the Supreme Court is an important restraint on judicial activism.

Senator Whitehouse stated “When you are on the court I hope you to conduct yourself and the court conducts themselves that no lawyer goes into the court and feels there is nothing to be done but to take their medicine and lose. That there would be fair trials.” After talking to the public and Amy Coney Barrett about two court cases named Abood and Janice.

Sheldon really seemed to reach out to Amy Coney Barrett cross party lines and favor bipartisan movement towards making America more beautifully unified.
